1. Scope and acceptance

These Terms govern your access to and use of the eToTheX.ai studio website, including its text, graphics, visual identity, links, and other content (collectively, the “Website”). If you do not agree to these Terms, do not use the Website.

The Website is informational. It does not itself create an account, process a payment, or grant access to an eToTheX.ai application, beta, TestFlight build, Play testing release, agent, or other product.

2. Product-specific terms

Individual products may be governed by separate terms, privacy notices, testing agreements, license terms, or platform rules presented with the product or invitation. Those product-specific terms govern your use of that product. If they conflict with these Website Terms, the product-specific terms control for that product.

3. Eligibility

You must be legally capable of entering into a binding agreement to use the Website. If you use the Website on behalf of an organization, you represent that you have authority to bind that organization to these Terms. The Website is not directed to children under 13.

4. Permission to use the Website

Subject to these Terms, eToTheX.ai grants you a limited, personal, non-exclusive, non-transferable, revocable permission to access and use the Website for lawful informational purposes. This permission does not transfer ownership of any Website content or intellectual-property right.

5. Acceptable use

You agree not to:

• use the Website in violation of law or the rights of another person;
• attempt to gain unauthorized access to the Website, its systems, or connected infrastructure;
• probe, scan, test, defeat, or circumvent a security or access-control measure;
• introduce malware, harmful code, excessive traffic, or any material intended to disrupt the Website;
• scrape, crawl, copy, or extract Website content by automated means in a manner that imposes an unreasonable burden, circumvents technical controls, or violates applicable law;
• misrepresent your identity or affiliation with eToTheX.ai;
• use our name, branding, or content to imply sponsorship or endorsement without written permission; or
• remove or alter copyright, trademark, attribution, or proprietary notices.

6. Intellectual property

The Website and its original content, visual identity, layout, design, graphics, software, and other materials are owned by or licensed to eToTheX.ai and are protected by copyright, trademark, and other intellectual-property laws. “eToTheX.ai,” associated marks, and related branding may not be used without prior written permission.

No right or license is granted by implication, estoppel, or otherwise except the limited permission expressly stated in Section 4.

7. Communications and feedback

If you email us, you are responsible for the information you choose to send. Do not send passwords, payment-card details, government identifiers, confidential third-party information, or other sensitive data that is unnecessary for your request.

If you voluntarily provide suggestions, ideas, or other feedback about the Website or our work, you grant eToTheX.ai a worldwide, perpetual, irrevocable, royalty-free right to use, modify, reproduce, and incorporate that feedback without restriction or compensation. This does not give us ownership of your pre-existing intellectual property or confidential information that we have expressly agreed in writing to protect.

8. Third-party services and links

The Website may reference or link to third-party websites, platforms, or services. We do not control and are not responsible for their availability, content, security, products, or practices. A link does not imply endorsement. Your use of a third-party service is governed by that party’s terms and policies.

9. No professional advice or reliance

Website content is provided for general informational purposes. It is not legal, medical, financial, security, engineering, or other professional advice. You are responsible for evaluating information and obtaining qualified advice appropriate to your circumstances.

10. Website availability and changes

We may modify, suspend, restrict, or discontinue all or part of the Website at any time. We do not guarantee that content will remain available, complete, current, or error-free. We may correct errors or update content without notice.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. ETOTHEX.AI DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Website will be uninterrupted, secure, available at a particular time or location, free from harmful components, or that defects will be corrected. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETOTHEX.AI AND ITS OWNERS, CONTRIBUTORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ETOTHEX.AI FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

These limitations do not exclude liability that cannot lawfully be excluded or limited, and they do not affect mandatory consumer rights.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless eToTheX.ai and its owners, contributors, service providers, and representatives from claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from your unlawful use of the Website, your material violation of these Terms, or your infringement of another person’s rights.

14. Enforcement and termination

We may restrict or terminate your access to the Website if we reasonably believe you have violated these Terms, created risk or possible legal exposure, or interfered with the Website or another person’s use. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, and general terms—will survive.

15. Informal resolution

Before filing a formal claim concerning the Website, please contact us at hi@eToTheX.ai with a description of the issue. We will attempt in good faith to resolve it. This section does not prevent either party from seeking urgent relief where appropriate or exercising rights that cannot be waived.

16. Changes to these Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated date. Changes apply prospectively when posted unless a later date is stated. Your continued use of the Website after updated Terms take effect constitutes acceptance of the revised Terms.

17. General terms

These Terms and any policies expressly incorporated by reference constitute the entire agreement between you and eToTheX.ai regarding the Website. If a provision is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Website or studio.
